Terms & Conditions
Effective from September 19, 2018 ("Effective Date")
1.1. These Encore Rewards Terms and Conditions, (the "Terms") govern the Encore Rewards Program.
1.2. For the purposes of the Program, any reference to "Chances" includes any Community Gaming Centre in British Columbia.
1.3. British Columbia Lottery Corporation ("BCLC") may amend or alter these Terms at any time. You can access the current Terms on the premises of any BC Casino or Community Gaming Centre and on the website www.EncoreRewards.ca.
2.1. “Base Points” means Points earned through qualified play and does not include Points given to players through promotions.
2.2. “Benefits” or “Rewards” mean Points rewarded to players by BCLC under the Program.
2.3. “Bonus Points”, “Bonus Prize” or “Bonus Prizing” means additional Points other than Base Points that may be rewarded to players, dependant on membership Status.
2.4. “Points” mean points that are rewarded to players for slot, electronic table game or table game play as well as points given to players through promotions.
2.5. “Encore Rewards Card” or “Encore Card” or “Card” means the card issued to a member of the Program after the application has been completed and signed by the player and accepted at the facility.
2.6. “Gaming Day” means the 24-hour period from 7:00:00 am on one day to 6:59:59 am the following day.
2.7. “Kiosk” means an Encore Rewards Kiosk available at participating BC Casinos and Community Gaming Centres.
2.8. “Program” means the membership and tiered bonus reward program established by BCLC for our players.
2.9. “Status” means the Diamond, Double Diamond, Triple Diamond or Elite status of the membership, which is dependent on the amount of play the player has.
2.10. “Bonus Points Accelerator” means additional Base Points awarded while playing on eligible slot machines, electronic table games or from qualified food and beverage purchases. Table games, alcohol purchases and tax are not eligible for the Bonus Points Accelerator.
3.1. Your participation in any aspect of the Program constitutes acceptance of the Terms currently in effect.
3.2. Membership is free and is granted and maintained at BCLC's discretion.
3.3. In order to become a member, you must:
3.3.1. complete, in full, the Encore Rewards application, either online at www.EncoreRewards.ca or in person or at a Kiosk, if available, at any BC Casino or Community Gaming Centre;
3.3.2. be at least 19 years of age; and
3.3.3. present government-issued photo identification in person, at any BC Casino or Community Gaming Centre.
3.4. Membership is only available to natural persons. Organizations and institutions are not eligible for membership.
3.5. You are only entitled to one membership per person.
3.6. The Program is not available to BCLC employees or BCLC contractors.
3.7. Membership is available to BCLC gaming service providers’ employees.
3.8. You are not eligible for membership in the Program if you are self-excluded, suspended or banned from a BC Casino or Community Gaming Centre.
3.9. All benefits and rewards are subject to availability.
3.10. Membership and its benefits are non-transferable.
3.11. You must abide by these Terms.
4.1. Personal information related to your Encore Rewards membership will be collected in accordance with the Freedom of Information and Protection of Privacy Act, British Columbia and will be used, accessed, disclosed and stored by BCLC, or a BC Casino or Community Gaming Centre, and their respective service providers both inside and outside of Canada:
4.1.1. to administer the Encore Rewards program, which includes distributing information about your account;
4.1.2. to administer and communicate with you about your account;
4.1.3. if you consent, to distribute relevant content, offers and promotional communications relating to BCLC’s and the BC Casino or Community Gaming Centres’ products and services to you;
4.1.4. to administer contests and promotions;
4.1.5. to administer responsible gaming programs, if you enroll in a program;
4.1.6. for research, survey and statistical purposes;
4.1.7. to customize the content and delivery of products and services;
4.1.8. to expedite enrolment in other services provided by BCLC and BC Casino or Community Gaming Centres that may be of interest to you;
4.1.9. to maintain the security of Encorerewards.ca, and for investigative purposes; and
4.1.10. to enforce our agreements, to comply with applicable laws and legal processes, including providing information as required by our regulators, law enforcement or other agencies.
4.2. By accepting these Terms, you agree that BCLC, BC Casino or Community Gaming Centre, and their respective service providers may use, access, disclose and store your personal information both inside and outside Canada for the above purposes.
4.3. You must keep your personal information up to date and must notify BCLC or a BC Casino or Community Gaming Centre of any change(s). You may change some of your personal information online, once you have registered for an online account. Some changes may also be made by contacting BCLC’s Customer Support Centre or at a Kiosk at a BC Casino or Community Gaming Centre. All other changes must be made in person at a BC Casino or Community Gaming Centre and you must present government-issued photo identification when the change is requested.
4.4. If you elect to provide shared contact information, such as an email address that is accessible by yourself and another individual(s), personal information, including account balances and point activity, may be sent to this address. In some cases, BCLC or a BC Casino or Community Gaming Centre may not be able to send all communications to you. By providing shared contact information, you consent to BCLC disclosing your personal information to the other users that share the contact information.
4.5. When you apply for an Encore Rewards membership, you will be able to indicate your communication preferences. You may amend your preferences if you sign up for an online account, by contacting BCLC or at a Kiosk or in person at a BC Casino or Community Gaming Centre. Regardless of your promotional communication preferences, BCLC or a BC Casino or Community Gaming Centre may still need to send important non-promotional information to you about your account.
4.6. If you have any questions about the collection or use of your personal information, please contact the BC Casino or Community Gaming Centre you received the communication from or BCLC’s Customer Support Centre at 74 West Seymour Street, Kamloops, BC, V2C 1E2, Telephone 1-866-815-0222 or bclc.com.
5. MEMBERSHIP CARDS
5.1. All Encore Rewards Cards (“Cards”) remain the property of BCLC.
5.2. You may not have more than three (3) valid Cards inserted in gaming devices at any time.
5.3. Only you may use your Card. You must not give your Card to another person.
5.4. You must immediately report lost, stolen, or malfunctioning Card to BCLC or a BC Casino or Community Gaming Centre.
5.5. BCLC and its service providers are not responsible for any loss caused by the misuse of your Card.
5.6. BCLC may replace a lost, stolen or damaged Card in its discretion upon presentation of government issued photo identification in person at a BC Casino or Community Gaming Centre. BCLC reserves the right to charge a fee for replacement Cards or to terminate your membership if BCLC decides you have claimed an excessive number of lost, damaged and/or stolen cards.
6. ENCORE REWARD BENEFITS
6.1. Points can be earned and redeemed at any BC Casino or Community Gaming Centre. Further information about earning and redeeming Points can be obtained onsite at a BC Casino or Community Gaming Centre, from the BCLC Customer Support Centre and online at www.EncoreRewards.ca.
6.2. You earn Points and may receive Bonus Prizes if you play eligible slots, electronic table games, or table games at any BC Casino or Community Gaming Centre while your Card is inserted into the card reader at slots or electronic table games, or provided to the appropriate tables game dealer or Dealer Supervisor.
6.3. You cannot earn Points while playing poker or participating in a tournament of any kind.
6.4. You can earn Points on dining at participating food and beverage venues at BC Casino and Community Gaming Centres.
6.5. To be eligible for benefits, it is your responsibility to ensure that your Card is provided to the food and beverage staff, or, for gaming, inserted properly into the slot machine or eligible electronic table game, and remains in the machine while you play or, for table games, is given to the appropriate table game dealer or Dealer Supervisor.
6.5.1. On table games, it is your responsibility to ensure that a Dealer Supervisor is aware of your play and has been provided with your Card.
6.6. Points are redeemable for free play, or other prizes as determined by BCLC from time-to-time.
6.7. Points are awarded subject to system availability.
6.8. The amount of Points you can earn on slots or electronic table games is based on the following factors:
6.8.1. The game played
6.8.2. The amount wagered
6.8.3. Your Encore Rewards Membership Status at the time of play.
6.9. The amount of Points you can earn on table games is based on the following factors:
6.9.1. The table game played
6.9.2. The amount wagered
6.9.3. The time played
6.9.4. Your Encore Rewards Membership Status at the time of play.
6.10. The amount of Points you can earn for dining is 1 Point for every $1 spent on qualified food and beverage purchases.
6.10.1. You cannot earn Points on alcohol purchases.
6.10.2. You cannot earn Points on tax.
6.10.3. Qualified food and beverage purchases vary at each participating BC Casino and Community Gaming Centre. You are responsible for confirming a purchase qualifies to earn Points before making the purchase.
6.10.4. If you forget your Encore card, you can claim your unearned points by presenting your dining receipt and your Encore card to Guest Services at the casino or Chances location where you dined within 10 days.
6.11. BCLC reserves the right to change or restrict Point earnings or other awards on specific slot machines, table games, other games and food and beverage purchases.
6.12. Promotions may be offered to you from time to time, and may be subject to specific promotion conditions. Promotions may be subject to date and time restrictions.
6.13. You must notify BCLC of any omissions or discrepancies to your Point balance within sixty days of earning, receiving or using the applicable Points. BCLC may require you to provide documentation in support of any requested correction.
6.14. BCLC will not be liable for and may adjust or cancel your Point balance where Points have accrued due to malfunction, operator error, misrepresentation, fraud, misuse or any other reason BCLC deems valid.
6.14.1. In the instance of system error of Point transactions, adjustments will not be made to player accounts where the difference (in favour of or against the player) is less than one (1) dollar within a single Gaming Day.
7. MEMBERSHIP STATUS
7.1. The Encore Rewards Program has 4 membership Status levels for Point earnings – Diamond, Double Diamond, Triple Diamond and Elite.
7.2. You will be assigned a Membership Status level (“Status”) determined by the Base Points you earn during a Membership Status period (each a “Period”) while playing eligible slot machines, electronic table games, table games, or from qualified food and beverage purchases.
7.2.1. Base Points do not include Points given or credited to you as part of a promotion (such as point multipliers, Bonus Points, or promotional points).
7.2.2. A Period commences on 1 September and will end after a period of twelve (12) months. If you join the Encore Rewards Program other than on 1 September, your first Period will continue until the following 1 September. Evaluation by BCLC of the amount of Base Points required for Status upgrades and downgrades occur at the end of each Period.
7.2.3. Throughout a Period, upgrades to higher Statuses are processed on a daily basis. When you are upgraded during a Period, a new Period will not commence.
7.3. Bonus Point Accelerators are earned in addition to Base Points, as a percentage of Base Points earned during play. The percentage Bonus Accelerator is based on your Status level:
7.3.1. Double Diamond – 5% bonus
7.3.2. Triple Diamond – 10% bonus
7.3.3. Elite – 15% bonus
7.4. Bonus Points Accelerators are awarded based on your Status level at the time they are earned. Bonus Points Accelerators cannot be earned or applied retroactively. .
7.5. The benefits you are eligible for are based on your Status as outlined on the website www.EncoreRewards.ca and in the Welcome Package available at any BC Casino or Community Gaming Centre as may be amended from time to time by BCLC.
8. REDEEMING POINTS
8.1. Redemption of Points is subject to system and BC Casino and Community Gaming Centre availability.
8.2. A deceased member’s Points may be redeemed by the Executor or Administrator of the deceased’s estate upon presentation of either the will and death certificate or a letter from the estate’s lawyer confirming the recipient’s appointment as the estate’s Executor or Administrator.
8.3. Points will not be paid out in cash, except in accordance with these Terms, and at BCLC’s discretion.
8.4. A Personal Identification Number (“PIN”) and your Card are required to redeem Points on slots or electronic table games, or at tables.
8.5. You are solely responsible for any activity on your account when the account is accessed by using your Card and PIN.
8.6. You must notify BCLC immediately if you suspect unauthorized use of your account.
8.7. You must keep your PIN confidential and secure.
8.8. Points can be redeemed for free play at a gaming device, such as slots or electronic table games, or at Guest Services at a BC Casino for table games. Points redeemed for table games will be issued as a free play voucher. Vouchers can only be used for table game play and the entire value of the voucher must be used in a single bet. Vouchers expire at the end of the Gaming Day on which they are issued. Unused vouchers or portions of vouchers are void and will not be returned to your Points balance.
8.9. The minimum Points redemption amounts are:
8.9.1. $5.00 in Points for slots or electronic table games; or
8.9.2. $10.00 in Points for table games.
8.10. After the minimum Points redemption amount is met, you may be able to redeem Points in increments. Availability of incremental redemption is dependant on the game for which the Points are redeemed.
8.11. For slot machines and electronic table games, any Points that you redeemed but did not use are automatically returned to your Points balance when you remove your card.
9. CANCELLATION OF POINTS
9.1. If another person uses your Card, you may have your membership either terminated or suspended at BCLC’s sole discretion and BCLC may cancel all Points or other rewards in your account.
9.2. BCLC will suspend or cancel your Points or other rewards if you have been barred, banned, or suspended.
9.3. BCLC will close your account and pay out the Points balance if you have self-excluded. Self-excluded players cannot reactive their accounts while they are self-excluded.
9.4. In the event your Card does not register a transaction within a continuous 12-month period, BCLC will cancel any Points and may terminate or deactivate your membership.
9.5. Unused Points expire 365 days after they are earned.
9.6. Points and any other benefits cannot be reclaimed after cancellation or termination of your account.
9.7. You may cancel your membership at any time by visiting a BC Casino or Community Gaming Centre and showing government-issued photo identification.
9.7.1. A cancelled membership can be reinstated by visiting a BC Casino or any Community Gaming Centre and showing government-issued photo identification.
10.1. BCLC reserves the right to revoke or deny you membership if you misuse your Card or your account or if you do not comply with these Terms.
10.2. BCLC reserves the right to cancel Points and other benefits obtained through misuse of your Card.
10.3. BCLC may suspend or terminate your membership if BCLC decides that your actions are bringing the Program into disrepute.
11. ENCORE REWARDS MEMBER SITE AND KIOSKS
11.1. If you have a valid, active account, you have the option to view your account information including point earning and redemption activities via a secure web-based Member Site ("Member Site"). You may also view your account information at a Kiosk at a BC Casino or Community Gaming Centre. You may update your contact information, except your name, on the Member Site or at a Kiosk. You may re-print your Encore card at a Kiosk. All other changes must be made in person at a BC Casino or Community Gaming Centre.
11.2. Any use of the Member Site or a Kiosk, and their services, are subject to these Terms.
11.3. If you signed up for membership in person at a BC Casino or Community Gaming Centre, you must activate your account on the Member Site. Accounts are automatically activated for Members who sign up online.
11.4. You are responsible for selecting a Password (“Password”) for the Member Site. You must keep your Password confidential and secure.
11.5. You are solely responsible for any activity on your account when the account is accessed by using your Password.
11.6. You must immediately notify BCLC if there is any suspected unauthorized use of your account on the Member Site.
11.7. If you register for the Member Site you authorize BCLC to communicate with you about matters concerning your account, or to provide important information about new or existing account services available to you.
11.8. Information on your account and transactions displayed via the Member Site are:
11.8.1. Subject to data delays and may be based on information that is outdated at time of viewing;
11.8.2. Based on a Gaming Day.
11.9. BCLC does not guarantee the accuracy, quality or reliability of, nor will BCLC be held liable for any content on the Member Site.
11.10. You may download or otherwise obtain material through any use of the Member Site at your own discretion and risk and you acknowledge and agree that you will be solely responsible for any damage to your computer system and any loss of data that results from your use of the Member Site.
12.1. These Terms replace all previous Encore Rewards Program Terms and Conditions.
12.2. All decisions regarding the interpretation of these Terms lie solely with BCLC whose decisions will be binding.
12.3. Neither BCLC nor any of its related parties or service providers shall be liable for any damages or loss of any kind whatsoever including, without limitation:
12.3.1. the use of or inability to use the Member Site or a Kiosk or their services;
12.3.2. any unauthorized access to or alteration to a Member name, Password or any other transmissions or data;
12.3.3. any statements or conduct of any individual who in any way uses, or is connected to the Member Site;
12.3.4. the use or disclosure of a member’s Encore Rewards information, including personal information, by a BC Casino or Community Gaming Centre, a service provider or contractor, or a subcontractor or service provider or any of these, including, without limitation, in communications from, or contests or promotions offered by service providers or a BC Casino or Community Gaming Centre;
12.3.5. any statements, conduct, actions or omissions, including, without limitation the negligence, breach of contract or any other wrongful act on the part of any party whatsoever, including, without limitation, BCLC or a related party;
12.3.6. any damages (including direct, indirect, special, incidental, consequential, punitive, lost profits, lost savings, lost or corrupted data, or any other damages) arising out of or related to the Encore Rewards Program, regardless of the legal theory upon which any claim for such damages is based, whether based on breach of warranty, contract, tort (including negligence), strict liability, or otherwise and even if advised of the possibility of any such damages; and
12.3.7. any other matter relating to the Encore Rewards Program, the Member Site or a Kiosk or their services.
12.4. All contests, promotions, prizes, giveaways and other Member Site benefits are governed by and subject to all applicable Rules and Regulations and Conditions, including these Terms.
12.5. BCLC may, in its sole and absolute discretion, modify, suspend or discontinue any portion of the Encore Rewards Program or the Member Site at any time without notice. Additionally, BCLC may modify the Rules and Regulations and Conditions, including these Terms, at any time without any prior notice.
12.6. If any provision of these Terms is found to be invalid, all other provisions shall remain in effect.
12.7. These Terms shall be governed by the laws of British Columbia and the laws of Canada applicable in British Columbia.
12.8. BCLC reserves the right to modify, suspend, or cancel this Program at any time, for any reason.
Appendix ‘A’ – PlayPlanner Terms and Conditions
1.1 PlayPlanner is an optional slot machine and electronic table game (collectively “Electronic Gaming Devices”) budgeting tool provided to Encore Rewards members and to promotional card holders (“PlayPlanner”).
1.2 PlayPlanner is trial program currently provided by BCLC at the Cascades Kamloops Casino and Chances Kamloops facilities only.
1.3 PlayPlanner provides reminders on the interactive touch screen at slot machines and electronic table games with respect to time and money limits that a player has set using the tool.
1.4 Use of PlayPlanner by an Encore Rewards member is subject to the Terms.
1.5 BCLC reserves the right at its sole discretion to modify or cancel PlayPlanner including these terms and conditions without notice.
2. HOW TO USE PLAYPLANNER
2.1. Encore Rewards members can use PlayPlanner by inserting their Encore Rewards Card in an Electronic Gaming Device and selecting the option to use PlayPlanner. Promotional card holders can use PlayPlanner by inserting their promotional card in an Electronic Gaming Device and selecting the option to use PlayPlanner.
2.2. A player who elects to use the tool will be prompted to set limits as follows:
2.2.1. The amount of time which he/she wants to play Electronic Gaming Devices in the current calendar day (“Time Limit”) and/or
2.2.2. The money amount of money he/she want to play Electronic Gaming Devices in the current calendar day (“Money Limit”)
(Time Limit and Money Limit collectively referred to as (“Limits”)).
2.3 The amount of money selected for a Money Limit is the approximate net-loss on Electronic Gaming Devices played by that player in a calendar day.
2.4 A calendar day for the purposes of the Limits is from 12:00 a.m. one day up until 12:00 a.m. the next day.
2.5 A player’s card must be properly inserted in any Electronic Gaming Device played in order for the PlayPlanner tool to function.
2.6 Reminders are scheduled to appear as the player reaches approximately 50%, 90%, 100%, 150% and 200% of the Limit(s).
2.7 PlayPlanner does not restrict players from further play beyond Limit(s). The reminders designed to appear upon reaching 100% of a Limit requires a player to tap OK to resume play. All other reminders are designed to appear temporarily without any steps required from a player to continue play.
2.8 PlayPlanner is designed to enable a player to decrease a Limit immediately. However, increases to a Limit require a 24 hour waiting period to take effect.
3. LIMITATIONS OF LIABILITY
3.1. In offering PlayPlanner, BCLC and its service providers do not assume any responsibility to monitor a player’s gaming activities.
3.2. PlayPlanner is offered “as is” without any express or implied representation, warranty or condition of any kind, including but not limited to any warranty or condition of fitness for any particular purpose. Without limiting the generality of the foregoing, no warranty is made that PlayPlanner will be error-free including without limitation errors with respect to lost, misdirected, delayed, or incorrect reminders.
3.3. In no event will BCLC or its related parties be liable for any damages (including direct, indirect, special, incidental, consequential, punitive, lost profits, lost savings, lost or corrupted data, or any other damages) arising out of or related to the use of PlayPlanner regardless of the legal theory upon which any claim for such damages is based, whether based on breach of warranty, contract, tort (including negligence), strict liability, or otherwise and even if advised of the possibility of any such damages.
